Terms of Service

These Terms of Service (“Terms”) govern access to and use of outbid.day (the “Service”), including the public leaderboard, product pages, checkout, and related features. By using the Service, creating a listing, or completing a payment, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the Service and do not pay for a ranking. Before checkout you must confirm that you have read and agree to these Terms.

Operator and contact

The Service is operated by Hridoy (“we”, “us”, “our”) as an unincorporated sole proprietorship. Questions, complaints, or rights notices can be sent to hello@outbid.day. We aim to respond within 30 days.

What the Service is

outbid.day is a public, daily leaderboard where anyone can pay to claim a ranking slot for a product URL. The slot is held until a higher payment is placed, or until midnight UTC when the day settles into a permanent archive. The Service ranks entries by payment amount; it is not a search engine and does not endorse any listed product.

Eligibility

You must be at least 18 years old and able to enter a binding contract in your jurisdiction to use the Service. If you are creating a listing on behalf of a company, you represent that you have authority to bind that company to these Terms.

Payments, Stripe, and taxes

Payments are processed by Stripe under their terms and privacy policy. The amount you pay is the listing price in U.S. dollars; we do not add platform fees on top of the bid you accept at checkout. You are responsible for any taxes applicable in your jurisdiction.

Sponsored placement; payments to outbid.day

Payments go to outbid.day for sponsored placement on the leaderboard — they are not paid to the owner of the underlying product, tool, or service that the listing links to. The product owner has no relationship to the payment unless they have separately purchased a listing of their own. Rank on the leaderboard reflects payment amount only and is not an endorsement, recommendation, or quality judgment by outbid.day.

No refunds

All sales are final. Once a payment is confirmed by Stripe, the listing is published to the public leaderboard and the funds are committed. We do not offer refunds for change of mind, accidental submission, or being outbid within the same day. If a payment fails after submission, the listing is not created and you are not charged.

What you can list

Anyone can bid on any URL — outbid.day is a paid ranking service, not an ownership or authorization gate. The URL must resolve to a publicly reachable page that visitors can open and use. It must not be a parked domain, a login wall, a generic landing page, or a page whose public metadata is unrelated to what the page actually shows. We do not verify whether you own, operate, or have any relationship to the URL you submit. If you do have a relationship to it, you can include that context in any communication with us; if you don’t, that’s fine too — the listing will simply display whatever the URL’s public metadata says.

Terms agreement

Before completing checkout you must confirm, by checking a box, that you have read and agree to these Terms of Service and to the Privacy Policy. This is a binding agreement. We do not require you to represent that you own the URL — see “What you can list” above. Misrepresenting your identity to evade a prior ban, however, is a breach of these Terms and may result in removal of the new listing.

Your warranties

By submitting a listing you warrant that: (a) the URL you submit is publicly reachable and the page itself (not its metadata alone) contains content appropriate for display on the Service; (b) the product, tool, app, or service the URL describes complies with all laws applicable to it; and (c) you are not using the Service to facilitate fraud, to evade an existing ban, or to coordinate inauthentic activity. We do not require you to warrant that you own the URL or that you have permission from any third party — outbid.day displays what the URL’s public Open Graph metadata says, and the rights-notice channel is the appropriate place for any third party who disagrees with that display (see our DMCA & takedown procedure).

Prohibited listings and use

You may not list, link to, or promote: (a) illegal products or services; (b) content that infringes intellectual-property rights, including trademarks, service marks, trade dress, or brand impersonation; (c) malware, phishing pages, or deceptive downloads; (d) adult content, gambling, or controlled substances where prohibited; (e) weapons, explosives, or regulated financial products you are not licensed to offer; or (f) any content that is misleading, defamatory, or discriminatory. You also agree not to scrape, crawl, or otherwise automate access to the Service, and not to attempt to interfere with its operation or security. We maintain a starter denylist of well-known brand hostnames; see our DMCA & takedown procedure for the trademark-notice channel.

Our right to remove listings

We may, at our sole discretion and without prior notice, remove any listing that violates these Terms or that we reasonably believe is harmful to other users, to third parties, or to the integrity of the Service — including listings that impersonate a brand, whose URL is on our brand-protection denylist, or whose rights holder has filed a valid takedown notice. Where practicable we will notify the listing owner; however, repeated or serious violations may result in permanent removal without notice. Removal does not entitle the listing owner to a refund.

Fair use and third-party content

The Service surfaces favicons, titles, and descriptions from third-party sites using standard web protocols (such as Open Graph metadata published on the page itself). We do not collect user-supplied display names or taglines — what appears on the leaderboard is derived from the public metadata of the URL you submit. Display of a third-party name, logo, or favicon on the leaderboard is intended as nominative fair use of trademarks and as fair use of copyrighted material: we use only what is needed to identify the destination, we do not use it as our own brand, and we do not suggest sponsorship or endorsement by the rights holder unless the lister is that rights holder. License you grant us

By submitting a listing you grant us a non-exclusive, worldwide, royalty-free license to display the URL you submit and its publicly available metadata (display name, description, favicon, and any images surfaced by the page’s Open Graph tags) on the Service, in connection with the public leaderboard, the daily archive, and any promotional excerpts (for example, a social-media post mentioning a top-3 winner).

Complaints and rights notices

Copyright, trademark, and other rights notices can be sent to hello@outbid.day. The required notice elements, our 24-hour acknowledgement SLA, and the 1-business-day action window are documented in our DMCA & takedown procedure. We may remove or restrict a listing while we review the notice, and we may share the notice (with your contact details) with the listing owner.

Designated DMCA agent

Our designated agent for service of § 512(c) notices is reachable at hello@outbid.day. Email is the only valid notice channel at this time. Once a Form DMCA-1 designation is filed with the U.S. Copyright Office, the registered name and postal address will be published on the DMCA page and in the DMCA directory.

No endorsement, no earnings claims

The Service does not endorse any listed product. Order of ranking on the leaderboard reflects payment amount only; it is not a quality, popularity, or safety judgment. We make no representation that a listing will result in any particular traffic, sales, or business outcome.

Availability and changes

We may modify, suspend, or discontinue any part of the Service at any time, including specific features or the daily-archive mechanics. We may also update these Terms; the effective date at the top of this page reflects the most recent revision. Continued use of the Service after a change constitutes acceptance.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to your use of the Service will not exceed the amount you have paid to outbid.day in the 12 months preceding the event giving rise to the claim. We will not be liable for indirect, incidental, consequential, or punitive damages.

Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your listing content, or your violation of any third-party right.

Governing law

These Terms are governed by the laws of the jurisdiction in which the operator is established, without regard to conflict-of-laws principles. Any dispute will be resolved in the courts of that jurisdiction unless applicable consumer law requires otherwise.

General

If any provision of these Terms is held unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right or provision will not be deemed a waiver. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
